BUYER MAY PURCHASE REAL ESTATE PRIOR TO AUCTION

REAL ESTATE: The following three homes will be sold for one money.  All three homes have like new roofs, concrete block foundations, open front porches, basements and  large backyards. The homes have city water, sewer, and gas.

Home#1-Located at 921 College Ave. This home has a kitchen, living room, 2 bedrooms, bath and is in the process of being remodeled. The walls and ceilings have been recently painted.

Home #2-Located at 923 College Ave. This home has a kitchen, living room, 2 bedrooms, bath, a newer gas forced air furnace and composition shingle roof.

Home #3-Located at 1101 S. 10th Street. This home is located on the southwest corner lot and includes a kitchen, living room, 2 bedrooms and bath. The home has a gas furnace.              

Home #4: This property at 1001 Washington Avenue will be sold separately from the

other three. This vinyl sided 2 bedroom, 1 bath home is on a corner lot and has a 1 car-plus

attached garage with an overhead door opener.  The home has a gas forced air furnace, window air, electric range and refrigerator. The home sits on a crawlspace and has a Lock Tite shingled roof.

NOTE: 923 College Avenue, 1101 S. 10th Street, and 1001 Washington Avenue are currently

rented and renters want to stay.

REAL ESTATE TAXES FOR HOMES #1, 2, & 3:  The real estate taxes are approximately $1,978 per year and will be pro-rated at closing.

REAL ESTATE TAXES FOR HOME #4:  The real estate taxes are approximately $983 per year and will be pro-rated at closing.

TERMS OF REAL ESTATE:  The Successful Bidder will deposit 10% of the contract purchase price (except for exempt entities) at the auction in the form of cash, cashier’s check or approved personal check or company check with bank letter of guarantee (no bank drafts).  The Buyer will sign a non-contingent real estate contract with the balance due in 30 days or thereafter within 5 days of presentation of insurable title.  The Real Estate will be sold “AS-IS” with no warranty, expressed or implied, but will be free and clear of any liens or encumbrances.  An ALTA 2006 Title Insurance Commitment in the amount of the contract price will be supplied to the Buyer by the Seller and Seller shall pay for title search, premium for owner’s policy and cost to correct any title defects. If obtaining a loan, the Buyer shall pay the mortgage policy.  The Buyer will pay for the recording of his/her necessary documents.  The Auction will conclude when the Auctioneer determines that all buyers have made their best and final offers.  Anyone desiring to bid must be approved prior to sale by Johnny Swalls.  Any statements made by the Auctioneer day of sale or during the sale take precedence over any oral or written heretofore. 

BUYER’S PREMIUM:  The Buyer will pay a 6% Buyer’s Premium which will be added to the bid price to arrive at the contract price.  The Buyer is only required to pay 10% down, of the contract price, day of sale. 

SURVEY:  The Buyer will pay for any Survey.             POSSESSION:  At Closing on the vacant home. The leases will be honored on the rented properties.
