REAL ESTATE:  The real estate consists of 32.50  Acres m/l that will be sold in two tracts or as a whole. 

Tract One:  Will be offered for sale by Mary Brazzell and Wayne Brazzell and consists of 10.56 Acres m/l.  It has a 1975 Skyline 14' x 70' Mobile Home with 3 bedrooms, 2 baths,  wood burner, ceiling fan, electric range, 3 window air conditioners, and a gas propane furnace, which is a couple of years old.  The property has a deep water well and a shallow water well.  In addition, there is a 30’ x 50’ garage with 3 overhead doors and 3 service doors.  The garage has  100 amp. electric  service, concrete floor and a loft with wooden stairs on 60% of the building.  This is a very nice building.  Tract One has a separate survey.

Tract Two: Will be offered for sale by Mary Brazzell and consists of 21.94 Acres m/l.  The property has woods and pasture land. This tract joins Tract One.

REAL ESTATE TAXES:  The real estate taxes are approximately: Tract One $350 per year and Tract Two $110 per year.  Both Tracts will be pro-rated at closing. 

TERMS OF REAL ESTATE:  The Successful Bidder will deposit 10% of the contract purchase price (except for exempt entities) at the auction in the form of cash, cashier’s check or approved personal check or company check with bank letter of guarantee (no bank drafts).  The Buyer will sign a non-contingent real estate contract with the balance due in 30 days or thereafter within 5 days of presentation of insurable title.  The Real Estate will be sold “AS-IS” with no warranty, expressed or implied, but will be free and clear of any liens or encumbrances.  An ALTA 2006 Title Insurance Commitment in the amount of the contract price will be supplied to the Buyer by the Seller and Seller shall pay for title search, premium for owner’s policy and cost to correct any title defects. If obtaining a loan, the Buyer shall pay the mortgage policy.  The Buyer will pay for the recording of his/her necessary documents.  The Auction will conclude when the Auctioneer determines that all buyers have made their best and final offers.  Anyone desiring to bid must be approved prior to sale by Johnny Swalls.  Any statements made by the Auctioneer day of sale or during the sale take precedence over any oral or written heretofore. 

BUYER’S PREMIUM:  The Buyer will pay a 6% Buyer’s Premium which will be added to the bid price to arrive at the contract price.  The Buyer is only required to pay 10% down, of the contract price, day of sale.

SURVEY The Buyer will pay for the Survey, if one is needed, and Survey will be completed after Closing.

MINERAL RIGHTS: Any minerals owned by the Seller will transfer to the Buyer.

POSSESSION:  Possession day of closing.
